This End User License Agreement ("Agreement") is between you and KernSafe Technologies Limited ("KernSafe"). By installing or using KernSafe KVault Initiator (the "Software"), you agree to this Agreement. If you do not agree, do not install or use the Software.
KernSafe grants you a limited, non-exclusive, non-transferable license to install and use the Software on compatible macOS computers for your internal business or personal use, subject to the applicable purchase or subscription terms.
You may not reverse engineer, decompile, disassemble, modify, distribute, rent, lease, sublicense, or resell the Software except as expressly permitted by applicable law or by written agreement with KernSafe.
The Software can access, mount, write, encrypt, organize, and manage data on local or remote storage. You are responsible for selecting appropriate storage settings, maintaining current independent backups, verifying backup integrity, and confirming that you have authorization to access the storage and data. Do not use the Software as your sole copy of important data.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AVAILABILITY, OR ERROR-FREE OR UNINTERRUPTED OPERATION. KERNSAFE DOES NOT WARRANT THAT THE SOFTWARE WILL PREVENT DATA LOSS, DATA CORRUPTION, SECURITY INCIDENTS, OR SERVICE INTERRUPTIONS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KERNSAFE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, DATA CORRUPTION, LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF BUSINESS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SOFTWARE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KERNSAFE'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SOFTWARE WILL NOT EXCEED THE LICENSE FEES ACTUALLY PAID BY YOU FOR THE SOFTWARE GIVING RISE TO THE CLAIM. If the Software was provided without a fee, KernSafe's total aggregate liability will not exceed the amount paid by you for the Software, which is zero.
The Software may interact with third-party storage systems, networks, protocols, and services. Those systems are governed by their own terms and may be unavailable, changed, or interrupted without notice. KernSafe is not responsible for third-party systems or their data.
This Agreement ends when you stop using and remove the Software, or when you breach its terms. Upon termination, you must stop using the Software and remove all copies in your control.
This Agreement does not limit rights that cannot legally be limited. If any provision is unenforceable, the remaining provisions remain in effect. This Agreement is the complete agreement concerning the Software unless a separate written agreement applies.
